Jika Perdana Menteri hilang majoriti?


Menurut Perkara 43 (4) Perlembagaan Persekutuan, Perdana Menteri perlulah meletak jawatan jika tidak lagi mendapat kepercayaan majoriti ahli Dewan melainkan jika atas permintaannya Parlimen dibubarkan oleh Yang DiPertuan Agong.

Dalam kes Dato' Seri Ir Hj Mohammad Nizar Jamaluddin v Dato' Seri Dr Zambry Abdul Kadir [2010] 2 CLJ 925 di mana Mahkamah Persekutuan memutuskan:

"(55) ...it would lead to political uncertainty in the State. The appellant cannot continue to govern after having lost the support of the majority. To allow him to do so would be going against the principle of democracy..."

Berdasarkan kepada keputusan Mahkamah Persekutuan di atas dan jika Perdana Menteri telah hilang sokongan majoriti maka adalah wajar meletak jawatan. 

Ini adalah kerana situasi ini akan membawa kepada ketidaktentuan politik dan jika dibiarkan Perdana Menteri terus menjalankan tugas beliau adalah bertentangan dengan prinsip demokrasi.

Dalam kes yang sama Mahkamah Persekutuan memutuskan:

"(52)...is made to know that he has lost the confidence of the majority of the member of the Legislative Assembly, he should take the honourable way out by tendering his resignation and the resignation of Executive Council. If the Menteri Besar refuses or does not tender his resignation and the resignation of Executive Council, as had happened in this case, the fact remains that the Executive Council is dissolved (which include the Menteri Besar) on account of the Menteri Besar losing the confidence of the majority of the Legislative Assembly..."

Oleh itu, jika Perdana Menteri enggan meletak jawatan secara terhormat maka bolehlah dianggap barisan kabinet beliau telah terbubar "is dissolved" kerana tiada lagi majoriti sokongan ahli Dewan.
